Agreement to these terms

These terms govern your use of this website and any quote request, engagement, or project undertaken with AppForge Digital ("we", "us", "our"). By submitting a quote request or engaging us for work, you agree to these terms.

Quote requests are non-binding

Submitting a quote request through this website, by email, or by any other means does not create a contract or any obligation on either side. We'll review what you've shared and respond with a scope and a quote. Work only begins once a quote has been explicitly accepted by you — for example, by replying to confirm — at which point the terms of that specific quote (scope, price, timeline where stated) apply alongside these general terms.

Payment

Payment terms are agreed on a per-project basis and will be set out in the applicable quote (for example, a deposit and final payment, or milestone-based payment). Unless a quote states otherwise, payment is due as agreed per that quote before final delivery or handover of the completed work.

Intellectual property

Ownership of the custom deliverable built specifically for you — the app, webpage, automation, or report described in your accepted quote — transfers to you upon full payment as agreed in that quote. Until payment is complete, AppForge Digital retains ownership of the work.

We retain ownership of our own general-purpose tools, code libraries, frameworks, and know-how used to build your deliverable, to the extent they aren't unique to your project — this lets us keep improving how we build for future clients without those improvements being owned by any single client. We may also reference completed projects in general terms (for example, in case studies) unless you've asked us in writing to keep a specific engagement confidential.

Turnaround time

We aim to respond to quote requests within 1–2 business days. Beyond that initial response, we don't guarantee a specific build or delivery timeframe unless one is explicitly stated in an accepted quote — project timelines vary with scope and complexity, and will be communicated as part of the quoting process.

Limitation of liability

To the maximum extent permitted by law:

• We aren't liable for indirect, incidental, or consequential loss arising from your use of a deliverable we've built, including loss of profits, data, or business opportunity;
• Our total liability for any claim arising from an engagement is limited to the amount you paid us for that specific engagement;
• You're responsible for verifying that any business decisions made using a tool, automation, or report we've built are appropriate for your circumstances — we build to the specification agreed in your quote, but the underlying business judgment remains yours.

Nothing in these terms excludes any consumer guarantee or right that can't lawfully be excluded under the Australian Consumer Law.

Acceptable use

You agree not to use this website to submit anything unlawful, fraudulent, or intended to disrupt or misuse the site or the quote process.

Changes to these terms

We may update these terms from time to time. The "last updated" date above reflects the most recent change. Continued use of the site or an ongoing engagement after a change means you accept the updated terms; any project already underway remains governed by the terms of its accepted quote unless we agree otherwise.

Governing law

These terms are governed by the laws of Western Australia, Australia, and each party submits to the non-exclusive jurisdiction of its courts.
